High Court Judge Michael Elubu has dismissed with costs a case in which an FDC member Nakanwagi Grace was challenging the nomination of Habib Buwembo as the Party Flag bearer for Rubaga South Constituency.
In Justice Elubu’s ruling read by the Deputy Registrar Jameson Karemani, the Judge informed Nakanwagi that she should have petitioned the party Commission first before rushing to court.
The ruling further stated that she had to act according to the party constitution’s guidance on members who are aggrieved by results from party primaries.
The judge also faulted Nakanwagi for having failed to adduce sufficient evidence in support of her allegations against Buwembo.
This week, Nakanwagi petitioned court alleging that party officials elected her as the official party flag bearer but later she was robbed of her victory by a group of individuals who declared Habib Buwembo the winner.
Yesterday evening, Buwembo was nominated by the Kampala District returning officer to contest on the same seat in the forth coming elections on FDC ticket.
