
Kampala’s elected Lord Mayor and lawyer Erias Lukwago has expressed hope that his client Dr. Kizza Besigye might be released from house arrest where he has been held without trial for more than a month.
This Lukwago noted after the Kasangati Grade one Magistrate, Prossy Katushabe denied State their request to dismiss the case that was filed against the Inspector General of Police and the area Police Commander ordering them to stay away from Dr. Besigye’s home.
Lukwago told the media outside court that despite the State playing tricks and raising several technicalities to drag the case, the Magistrate stood her ground to proceed with the matter.
Court had earlier ruled to proceed handling the case despite State alluding that it had no jurisdiction, since this is a criminal prosecution that should be handled by the High Court.
This was rejected by the Deputy Director of Public Prosecution (DPP), Caroline Nabasa calling for the revision of the court ruling before the High Court.
“We still object the way the case was reinstated; we are not satisfied with the ruling that this court should continue hearing the case,” she said. “We wish to apply to the High Court for purposes of satisfying the correctness of the proceedings before this court.”
The Magistrate Katushabe advised State that the review of her earlier ruling could be done at anytime ordering them to file their submission by today evening waiting for the final determination of the matter tomorrow Tuesday.
