
Makindye Chief Magistrates Court has dismissed a case of disobedience of lawful orders against former FDC presidential candidate Dr. Kiiza Besigye for lack of evidence.
In this case Besigye has been jointly charged with Kampala city Lord Mayor Elias Lukwago and others for allegedly disobeying orders of Kampala South metropolitan police commander of that time Siraje Bakaleke.
Grade one magistrate Fortunate Nyapiri dismissed the case this morning following the prosecution’s failure to produce witnesses in court pinning the accused in this matter.
The two politicians had allegedly been barred by Bakaleke from addressing a rally at Sharing Hall Nsambya but insisted and went ahead to gather people’s views about Electoral reforms debate which at that time was on the floor of Parliament.
After the dismissal of the matter, Lukwago and Besigye vowed to consult their lawyers on the possibility of suing government for malicious prosecution.
This is the second case being dropped involving Dr Besigye in the past few weeks.
About a month ago, the Kasangati Magistrates court set free Dr Besigye on a ‘defiance’ case after the DPP “lost interest in the matter.”
