The Constitutional Court has made a U turn in its earlier decision where it had dismissed a petition in which Col Dr Kizza Besigye challenged some provisions of the Police Act.
Judges Egonda Ntende, Cheborion Barishaki, Irene Mulyagonja, Muzamiru Kibedi and Elizabeth Musoke agreed to reinstate the case after confirmed that indeed Besigye had not been informed of the date when the case was coming up for hearing.
The court had thrown out the case when Besigye and his lawyers failed to show up for the hearing.
The judges ordered the state attorney Charity Nabasa to file defence within one week and the ruling will be delivered on notice.
In 2011 Besigye petitioned constitutional court challenging Section 24 of the Police Act which grants Police Powers to arrest anybody who is suspected to be in the process of committing an offence against himself or the Public.
