The Constitutional Court has set 22nd October 2020 to deliver it’s ruling on the case in which Col Dr Kizza Besigye challenges some provisions of the Police Act, including one that allows police officers to conduct preventive arrests.
On 5th October 2020, Court dismissed Besigye’s petition after he and his lawyers failed to turn up in court for the ruling.
However, Besigye through his lawyers filed an application asking court to reinstate their petition.
He argued among others that he was never informed about the hearing date of the said matter.
The lawyers added that it is in the interest of Justice that the dismissal of the constitutional petition is set aside and the same is re-instated and determined on its merit.
In 2011 Besigye petitioned the constitutional court challenging Section 24 of Police Act which grants Police Powers to arrest anybody who is suspected to be in the process of committing an offence against himself or the Public.
He also challenged Section 24 of Criminal Procedure Act which also gives police related powers saying that these contravenes numerous sections of the constitution which is the Supreme law of the land.
