The defence side in the matter where 26 people are charged with offences relating to security alongside Nakawa Municipality MP Hon Michael Kabaziguruka have failed to reach an understanding with the prosecution on whether to continue with the hearing of this case in the absence of Kabaziguruka.
Recently, the Constitutional Court halted Kabaziguruka’s trial in the Court Martial until it pronounces itself on the matter in which Kabaziguruka brought before it challenging the legality of trial in the army court.
With Kabaziguruka out on bail which he got from High Court, state prosecution at Court Martial led by Major Raphael Mugisha had no choice but to keep asking for adjournments.
But in the last sitting, after getting complaints of delayed justice for the rest of the accused currently on remand, the army court advised that both defense and prosecution consider whether to withdraw charges against Hon Kabaziguruka pending the decision of the Constitution Court, so that prosecution of the rest of the suspects can carry on.
The two sides by Monday had not reached a common ground.
State Prosecutor Major Raphael Mugisha told court that his defence counterparts informed him that the suspects were not willing to carry on with the case in the absence of Kabaziguruka since details in his file directly affect some of them.
Court Chairman Lt Gen Andrew Gutti adjourned the matter to 30th October 2017.
